2022 Legislative Session Results: The Good, The Bad and The Ugly

Mark Woodall, AGC Georgia’s Director of Governmental Affairs, is visiting with members across the state to share the good, the bad and the ugly… and how new laws and regulations from the 2022 legislative session affect you and your company.

A core principle of both AGC Georgia and AGC of America is “less government is better.” While we rely heavily on our relationships with our colleagues at the AGC of America for concerns on federal legislation, our chapter staff are on the frontlines all year advocating for pro-business laws and regulations impacting Georgia’s commercial construction industry. While we have a pro-active agenda for most sessions, a majority of our resources are spent playing defense against many well-intended proposals that can lead to bad public policy. 

This year’s session was the second of a two-year legislative process, meaning all bills not making it to the finish line are no longer in play for future sessions. If a sponsor wants a topic to be brought back up for discussion, they would have to go through the process of introducing a new bill. 

AGC Georgia had a very successful year, providing meaningful input on behalf of the construction industry as we successfully helped push through pro-construction legislative proposals/measures. Maybe more importantly, we helped stop of bills that could have negatively impacted the construction industry and business community. 

Some of the key legislative proposals AGC Georgia was intimately involved in during the 2022 session were: 

House Bill 910 – Amended 2022 Budget secured $3.9M for Construction Workforce Development Programs

House Bill 1372 – New Call Before You Dig Requirements

House Bill 435 – Defeated this bill that would have exempted certain contracts secured though Cooperative Purchasing 

Senate Bill 438 – New Georgia Public Works Retainage Thresholds/5% for the life of the project
