2021 Legislative Session Results: The Good, The Bad and The Ugly

Mark Woodall, AGC Georgia’s Director of Governmental Affairs, is visiting with members across the state to share the good, the bad and the ugly… and how new laws and regulations from the 2021 legislative session affect you and your company.

A core principle of the entire AGC organization is “less government is better.” Our primary legislative agenda is to always play defense against many well-intended proposals that can lead to bad public policy. 

This year’s session was the first of a two-year legislative process, meaning all bills in play this year but not reaching the Governor’s desk for approval are still eligible for consideration when a new session of the General Assembly convenes in January 2022. 

AGC Georgia had a very successful year, providing meaningful input on behalf of the construction industry as we successfully helped push through many pro-construction legislative proposals/ measures. Maybe more importantly, we helped stop of bills that could have negatively impacted the construction industry and business community. 

Some of the key legislative proposals AGC Georgia was intimately involved in that made their way to the Governor’s desk for approval included: 

• House Bill 81: The state’s FY 2022 Budget – AGC Georgia and CEFGA continued our partnership on workforce development initiatives to secure $500,000 for CONNECT ACT Funding for K-12 Construction Programs. CONNECT stands for Creating Opportunities Needed Now to Expand Credentialed Training. 

• House Bill 435: Job Order Contracting – AGC Georgia stopped this legislation from moving through the legislative process during the 2021 session. It would have exempted certain local government construction contracts from the requirements of Georgia’s local government Public Works law.  

• Senate Bill 169: Electronic Signature for Construction Surety Bonds – AGC Georgia was involved in this legislation from the beginning of session, helping promote the benefits. It was signed into law. 

• Senate Bill 213:  Energy Savings Contracts –  AGC Georgia worked to amend the original legislation to maintain current non-energy savings thresholds at 15%. The bill as originally drafted would have raised the threshold to 50%.
